Terms of Use — AlcoStat

These Terms of Use ("Terms") apply to the AlcoStat mobile application ("the Application"), published by Andrey Shestakov ("we", "us", the "Service Provider"). By downloading or using the Application you agree to these Terms.

1. Licence

The Application is licensed to you, not sold. Your licence is granted under Apple's Licensed Application End User License Agreement (the "Standard EULA"), available at:

These Terms supplement the Standard EULA. Where the two conflict on matters of licensing, the Standard EULA prevails.

2. What the Application does — and does not do

AlcoStat is a personal record-keeping tool that lets you log drinks and view statistics about your own entries.

AlcoStat is not a medical device and does not provide medical advice. It does not calculate blood alcohol concentration and it must not be used to decide whether you are fit to drive, operate machinery, work, or take medication. If you have concerns about your alcohol consumption or your health, consult a qualified medical professional.

3. Your data

All data you enter is stored locally on your device. We have no access to it and cannot recover it for you. You are responsible for your own backups. Deleting the Application deletes its data. See our Privacy Policy for details.

4. AlcoStat Premium subscription

What it unlocks. AlcoStat Premium unlocks the full Analytics section of the Application: all metric cards, across all time periods. The rest of the Application remains free to use.

Plans. Premium is offered as an auto-renewable subscription in two lengths:

The exact price of each plan is shown inside the Application, in your local currency, before you confirm a purchase.

Billing. Payment is charged to your Apple ID account at confirmation of purchase.

Auto-renewal. Your subscription renews automatically at the same price for the same period unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period.

Managing and cancelling. You can manage your subscription and turn off auto-renewal in *iOS Settings → [your name] → Subscriptions*, or from *Settings → Manage Subscription* inside the Application. Cancelling stops future renewals; it does not cancel the current period, and your Premium access remains active until that period ends.

Free trials and offers. If a free trial or introductory offer is provided, any unused portion of it is forfeited when you purchase a subscription.

Refunds. All purchases are processed by Apple, and refunds are handled by Apple under its own policies. We cannot issue refunds. Requests can be made at https://reportaproblem.apple.com

If you are a consumer in the European Union, you have a statutory right to withdraw from a purchase of digital content within 14 days. Because all sales are made through the App Store, Apple administers this right on our behalf under the Apple Media Services Terms and Conditions; submit your request through the link above.

Regions where App Store purchases are unavailable. In storefronts where App Store payments cannot be processed (currently the Russian storefront), Premium features are provided free of charge, and no subscription is offered.

Changes to features and pricing. We may change the features included in Premium or the subscription price. A price increase does not apply to your existing subscription until you are notified and, where Apple or applicable law requires it, until you consent to the new price.

5. Acceptable use

You agree not to reproduce, distribute, or sublicense the Application, and not to reverse engineer, decompile, disassemble, or attempt to extract its source code, except and only to the extent that applicable law expressly permits this.

You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

6. Intellectual property

We retain all intellectual property rights in the Application, including its code, design, name, and branding. These Terms grant you no right to use our trademarks or branding.

7. Disclaimers and limitation of liability

To the fullest extent permitted by law, the Application is provided "as is" and "as available", without warranties of any kind. Some functions — loading and purchasing subscriptions — require an internet connection, and we are not responsible if they are unavailable because of your connection or your mobile carrier, including any data charges you incur.

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, including lost data or lost profits. Our total liability for any claim will not exceed the greater of (a) the amount you paid us for the Application in the 12 months preceding the claim, or (b) the minimum amount required by applicable law.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded. Nothing in these Terms limits your rights under mandatory consumer protection law.

8. Apple

You acknowledge that these Terms are between you and us, not with Apple, and that Apple is not responsible for the Application or its content.

Apple has no obligation to provide any maintenance or support for the Application; support is our responsibility, and you can reach us at AlcoStatApp@gmail.com.

Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you as a third-party beneficiary.

9. Termination

Your licence ends if you breach these Terms or if you stop using the Application. On termination you must stop using the Application and delete it from your devices. Termination does not affect refunds, which remain governed by Apple's policies.

10. Governing law

These Terms are governed by the laws of the Russian Federation, excluding its conflict of law rules. This does not deprive you of the protection of the mandatory consumer protection rules of the country in which you reside, and you may bring a claim in any court that has jurisdiction under applicable law.

11. Changes to these Terms

We may update these Terms. Material changes will be published on this page with a new effective date. Previous versions are available on request at AlcoStatApp@gmail.com.
